DUI Arrest:
Being charged with a drunk driving offense can be a very unnerving and problematic experience, and it starts with one simple event -- the DUI arrest. Given the importance of this small yet extremely consequential incident, motorists have to understand how a DUI arrest is carried out. In relation to this, here is a step-by-step look at a typical arrest involving a suspected drunk driving individual.
Before anything else, it is necessary to know that this type of arrest is ordinarily the result of a primary traffic violation. For instance, a police officer can command a motorist to stop if the former notices that the latter is going beyond the speeding limit, moving too slowly, or swerving from one lane to another. Once the driver has been pulled over, the officer will observe him and will ask for his license, insurance card, and vehicle registration. Next, if the police officer sees that the motorist is intoxicated, he will be required to take a sobriety test at that very location. Otherwise, if he looks sober enough, he can be released provided that he would deal with the primary traffic violation.
However, if the motorist takes the sobriety examination and fails it, he will be arrested for DUI and escorted to the designated police station. Afterwards, he will be obliged to undergo blood, urine, and/or breath testing. He can be released if he passes these tests but his primary violation would still be reported. If he fails the said medical examinations, he will receive a specific report informing him of his statutory suspension. Furthermore, if his license is authentic, he can be allowed to drive for only a particular period of time. Lastly, he shall be obliged to post bond and his automobile can be towed or confiscated depending on his DUI offense.
